This website is operated by Lawn Rover. Throughout the website, the terms “we”, “us”, “our” and “Lawn Rover” refer to Lawn Rover.
By accessing our website, using our services or purchasing products from us, you agree to be bound by these Terms of Service (“Terms”), together with any additional terms, policies, notices or documents referenced on our website.
These Terms apply to all users of the website, including customers, visitors, merchants, vendors and contributors of content.
Please read these Terms carefully before using our website or purchasing products from Lawn Rover. If you do not agree with these Terms, you should not use our website or services.
We may update or amend these Terms from time to time by publishing an updated version on our website. Your continued use of our website after changes are published constitutes acceptance of the updated Terms, to the extent permitted by law.
Our online store is hosted by Shopify Inc., which provides the e-commerce platform through which we sell our products and services.
SECTION 1 – WARRANTY
Lawn Rover Australia provides a one (1) year warranty against manufacturing defects and faults, subject to the exclusions and conditions set out in these Terms.
The warranty does not cover damage or faults caused by misuse, abuse, negligence, accidents, improper operation, unauthorised modifications or repairs, failure to follow operating instructions, or normal wear and tear and consumable items.
For approved warranty claims, Lawn Rover Australia will supply required replacement parts free of charge, subject to the applicable warranty conditions and shipping.
After the warranty period has expired, we remain committed to supporting our customers. Where available, replacement parts, accessories and other product-related items may be supplied at our cost price, with applicable shipping costs payable by the customer.
SECTION 2 – GENERAL CONDITIONS
We reserve the right to refuse or cancel service or an order where permitted by law.
You must not reproduce, copy, resell, distribute or commercially exploit any part of our website, products, services or intellectual property without our prior written permission.
Information submitted through our website may be transferred through networks and systems required to process your request or order. Payment information is handled through applicable secure payment processing systems.
SECTION 3 – WEBSITE INFORMATION
We make reasonable efforts to ensure that information on our website is accurate and current. However, information may occasionally contain errors, inaccuracies or omissions.
Product descriptions, images, specifications and other information are provided for general information and may change from time to time.
We reserve the right to correct errors or update information without prior notice.
Nothing on our website is intended to replace professional, technical or safety advice where such advice is required.
SECTION 4 – PRODUCTS, PRICING AND AVAILABILITY
Product availability, specifications and pricing may change from time to time.
We reserve the right to modify, discontinue or limit the availability of products or services, subject to any obligations that cannot legally be excluded.
Product images are provided for general illustration. Minor differences in appearance, colour, specifications or components may occur where reasonably necessary or where changes are made by the manufacturer.
Customers are responsible for considering whether a product is suitable for their intended application before purchase.
Nothing in these Terms excludes or limits any consumer guarantee, statutory right or remedy that cannot legally be excluded under the Australian Consumer Law.
SECTION 5 – MACHINE SAFETY AND OPERATION
Lawn Rover machines are designed to be operated in accordance with the applicable operating manuals, instructions, safety warnings and manufacturer's recommendations.
The customer is responsible for ensuring that anyone operating the machine has read and understood the applicable instructions and is competent to operate the equipment safely.
Pre-Operation Checks
Before operating the machine, the operator should:
- Read and follow the applicable operating instructions and safety warnings;
- Ensure the machine and remote control are adequately charged and functioning correctly;
- Inspect the machine for visible damage, loose components, leaks, abnormal wear or other issues;
- Check relevant components including the controls, cutting system, guards, fasteners, tyres or tracks and other safety components;
- Ensure the machine is appropriately maintained and serviced;
- Ensure safety guards and protective devices are properly installed and functioning; and
- Stop using the machine if a fault, warning, damage or abnormal behaviour is identified that may affect safe operation.
The machine should not be operated where the operator reasonably believes it may be unsafe or malfunctioning.
Slopes and Uneven Terrain
Lawn Rover machines are designed to operate on suitable sloping and uneven terrain when used within their specified operating limits.
We understand that our mowers may be used on slopes and inclines as part of normal mowing activities. However, suitable slopes should not be confused with extremely steep or hazardous terrain.
The machine should not be operated:
- Beyond the maximum slope or gradient specified by the applicable operating instructions or manufacturer;
- Where safe control cannot reasonably be maintained;
- On excessively steep, unstable, slippery or wet terrain;
- Where there is a foreseeable risk of tipping, overturning, sliding, rolling or falling; or
- Near embankments, drop-offs, cliffs, retaining walls, waterways or similar hazards where safe operation cannot reasonably be maintained.
For everyone's safety, please operate the mower within its recommended limits and avoid situations where the machine may become unstable or difficult to control, including attempting to climb near-vertical slopes.
Children, Animals and Bystanders
The operator must take reasonable precautions to keep children, animals and bystanders away from the machine and its operating area.
The machine must not be operated where there is a foreseeable risk of contact with people, animals, vehicles, buildings or other property.
The operator must maintain appropriate supervision and a safe operating distance at all times.
Damaged or Broken Blades
The machine must not be operated if a cutting blade is damaged, cracked, broken, loose, excessively worn or otherwise defective.
Damaged blades or blade fragments may cause serious injury or property damage. The operator should inspect the cutting system before use and replace damaged components before further operation.
SECTION 6 – MAINTENANCE AND UNAUTHORISED MODIFICATIONS
The customer is responsible for ensuring that the machine is appropriately maintained and serviced in accordance with the applicable operating instructions and manufacturer's recommendations.
Customers and operators must not modify, bypass, disconnect, reconnect, remove, reprogram or otherwise interfere with safety systems or other machine components unless expressly authorised by Lawn Rover or the manufacturer.
This includes, without limitation:
- Safety systems and protective devices;
- Electrical and wiring systems;
- Control and remote-control systems;
- Engines and drive systems;
- Cutting systems;
- Guards and protective components;
- Batteries and charging systems; and
- Features that have been disabled, restricted or disconnected by Lawn Rover or the manufacturer.
Unauthorised modifications or repairs may affect the machine's safety, performance and reliability and may affect warranty coverage where permitted by law.
SECTION 7 – CRUISE CONTROL
Where cruise control has been disabled, disconnected, restricted or otherwise made unavailable on a Lawn Rover machine, the customer and operator must not reconnect, reactivate, bypass or modify the machine to restore or enable that function unless expressly authorised by Lawn Rover or the manufacturer.
Unauthorised modification of the cruise-control system may affect the safe operation of the machine and may affect applicable warranty coverage.
Any person who modifies or interferes with the cruise-control system may create additional safety risks and may be responsible for consequences arising directly from that unauthorised modification, to the extent permitted by law.
SECTION 8 – CUSTOMER AND OPERATOR RESPONSIBILITIES
The customer and operator are responsible for:
- Using the machine only for its intended purpose;
- Following applicable operating instructions and safety warnings;
- Operating the machine with reasonable care and attention;
- Maintaining appropriate supervision and control;
- Keeping children, animals and bystanders at a safe distance;
- Ensuring appropriate maintenance and servicing;
- Stopping operation if a fault, warning or safety concern arises; and
- Using the machine only within its specified operating limitations.
The machine should not be operated while the operator is impaired, distracted or otherwise unable to safely control or supervise the machine.
SECTION 9 – MISUSE, NEGLIGENCE AND FAILURE TO FOLLOW INSTRUCTIONS
Lawn Rover expects all machines to be operated responsibly and in accordance with the applicable operating instructions, safety warnings and manufacturer's recommendations.
Misuse or improper operation includes using the machine in a manner inconsistent with its intended purpose, operating instructions, safety warnings or manufacturer's recommendations.
Examples may include:
- Operating on unsuitable or excessively steep terrain;
- Ignoring warnings, alarms or known faults;
- Operating a damaged or improperly maintained machine;
- Removing, bypassing or interfering with safety systems;
- Using the machine for an unintended purpose;
- Operating the machine after an unauthorised modification or repair;
- Failing to maintain reasonable control or supervision; or
- Failing to properly maintain or service the machine.
Where loss, damage or injury is caused directly by the customer's or operator's misuse, negligence, failure to follow safety instructions, operation outside the manufacturer's specified limitations, unauthorised modification or repair, or failure to properly maintain or operate the machine, Lawn Rover is not responsible for that loss, damage or injury to the extent permitted by law.
This does not affect any consumer guarantee, statutory right or remedy that cannot legally be excluded or limited under the Australian Consumer Law.
At Lawn Rover, we genuinely want you to enjoy using your machine and we're here to help if you ever need us. We simply ask that you take a little extra care when operating the mower, especially on slopes or around people, animals and obstacles. Please follow the operating instructions and safety guidance, and when in doubt, it's always better to stop and check with us first.
SECTION 10 – BILLING AND ACCOUNT INFORMATION
You agree to provide accurate and current billing, payment and account information and to update that information where necessary.
We reserve the right to limit or cancel orders where permitted by law.
SECTION 12 – PROHIBITED USES
You must not use our website or services:
- For an unlawful purpose;
- To violate applicable laws or regulations;
- To infringe another person's rights;
- To transmit malicious software or harmful code;
- To interfere with the security or operation of our website; or
- In a way that may cause harm to Lawn Rover Australia, our customers or other users.
SECTION 13 – AUSTRALIAN CONSUMER LAW AND LIABILITY
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, statutory right, remedy or liability that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable legislation.
To the extent permitted by law, Lawn Rover is not responsible for loss, damage or injury to the extent directly caused by:
- Misuse, abuse or improper operation;
- Failure to follow applicable operating instructions or safety warnings;
- Operation outside the manufacturer's specified limitations;
- Unauthorised modifications, alterations or repairs;
- Failure to properly maintain or service the machine; or
- Circumstances outside Lawn Rover's reasonable control.
Where the law permits Lawn Rover to limit its liability for a breach of a guarantee or obligation, Lawn Rover may, to the extent permitted by law, choose to:
- Repair the product;
- Replace the product;
- Supply an equivalent product; or
- Pay the reasonable cost of repairing or replacing the product.
Nothing in these Terms limits or excludes liability or consumer rights where doing so would be unlawful.
SECTION 14 – INDEMNIFICATION
To the extent permitted by law, you agree to indemnify Lawn Rover and its officers, employees, contractors and affiliates against reasonable losses, claims or costs arising directly from:
- Your breach of these Terms;
- Your unlawful use of our website or products;
- Your unauthorised modification of a product; or
- Your misuse or negligent operation of a product.
This does not apply to the extent that the relevant loss or liability is caused by Lawn Rover's negligence, breach of law or any matter for which liability cannot legally be excluded.
SECTION 15 – PRODUCTION AND DELIVERY TIMEFRAMES
Production:
Orders generally take approximately 2 to 5 business days to be prepared and completed prior to dispatch.
Shipping & Delivery:
Once your order has been dispatched, delivery generally takes approximately 20–25 business days, depending on the destination and freight network.
Once your order has been handed over to the freight carrier, we will provide you with the tracking link and tracking number so you can follow the progress of your shipment.
Please note that delivery timeframes are estimates and may vary depending on the delivery location, freight schedules, carrier processing times, and other circumstances that may affect transportation. As freight is handled through a third-party carrier, occasional delays can occur outside the normal estimated timeframe.
We will always provide the tracking details once available and keep you updated throughout the delivery process.
SECTION 16 – ENTIRE AGREEMENT
These Terms, together with any policies or documents expressly incorporated by reference, constitute the agreement between you and Lawn Rover regarding the use of our website and purchase of our products, subject to any rights that cannot legally be excluded.
